  • Prevailed in two-week jury trial on behalf of public pension in litigation confirming the termination of an investment property manager and recovering overcharged management fees.
  • Prevailed in bench trial defending an executive of a Fortune 500 company against fraud and punitive damage claims in real estate litigation arising from an executive relocation.
  • Prevailed in arbitration defending former CFO of a start-up medical device company in a $55 million fraud action brought by a Fortune 500 medical device company that acquired the start-up. At the conclusion of the two-week arbitration, the panel dismissed Mr. Rose's client and awarded him nearly $1 million in attorneys' fees and costs on Mr. Rose's motion.
  • Represented surround-sound technology company in disputes with several licensees, including successful preliminary injunction motion practice and numerous favorable settlements.
  • Represented national consumer products company in class action antitrust cases across the country, in trademark litigation targeting hundreds of counterfeit traffickers, and in trademark litigation targeting illegal Internet and tax-free sales.
  • Prevailed on summary judgment in multi-million dollar landlord/tenant litigation. Mr. Rose drafted the winning summary judgment motion and led the appellate briefing that resulted in the judgment being unanimously affirmed on appeal.
  • Successfully represented wireless technology company in employee stock option litigation, including obtaining a series of eight favorable summary adjudication rulings that disposed of the entire case.
  • Successfully enforced partnership rights for major tax credit syndicator in bankruptcy court adversary proceedings, including removing defaulting general partner via preliminary injunction and forcing a very favorable settlement by obtaining a writ of attachment.
  • Represented a major investment firm in a series of real estate and receivership lawsuits involving homebuyers, lenders, contractors, and multiple homeowners' associations arising in connection with a troubled master-planned community.
